We can't agree on everything, and it doesn't help the cause to concentrate on areas of disagreement. That said, when someone throws a brick through a church window, it's absurd to pretend that isn't a serious breach. A number of prominent self-styled conservatives have embraced the false premise that homosexuality is morally irrelevant or even something to be promoted through public policy. In her testimony before the Senate Judiciary Committee today, Solicitor General Elena Kagan, nominated to be an Associate Justice of the United States Supreme Court, did not give satisfactory responses to questions from Ranking Member Jeff Sessions on her record with regard to military issues. Elaine Donnelly, President of the Center for Military Readiness (CMR), drew attention to Kagan’s pattern of anti-military decisions. “In each case in which she has had an opportunity to side with military policy as stipulated in law, General Kagan has chosen the opposite position. Her record calls into question not only her legal judgment, but her lack of regard for the tradition of judicial deference to the other branches of government—a long-standing principle that is vital to national security.” Washington, DC – Fourteen members of Congress sent a letter today to Senate Judiciary Committee Ranking Member Jeff Sessions asking him to question Supreme Court nominee Elena Kagan about her role in the Obama administration’s decision to ask the Court to overturn a 2007 Arizona immigration enforcement law. The law allowed the state to revoke the business licenses of businesses that knowingly hire illegal immigrants. The provision was challenged but upheld in both the district court and the Ninth Circuit Court of Appeals. However, the Obama administration recently recommended that the Supreme Court review the case, Chamber of Commerce v. Candelaria (No. 09-115). Now the first fuss is coming back to haunt the Obama Administration, the professionals in the office of the Solicitor General, and maybe even Elena Kagan. That first fuss was over the Legal Arizona Workers Act, a 2006 Arizona statute that (1) imposed state penalties on employers who hire illegal workers and (2) required businesses in Arizona to use E-Verify. (E-Verify is a federal database that checks the names and Social Security numbers of new hires to make sure they match and thus makes it harder for illegal immigrants to get hired using made-up names and numbers.) WASHINGTON – With both the nominations hearing of Elena Kagan to the Supreme Court and the Supreme Court’s release of its decision in McDonald v. Chicago expected on Monday, U.S. Senator John Cornyn (R-TX), a member of the Senate Judiciary Committee, today raised concerns that Elena Kagan’s record indicates hostility toward gun rights and the Second Amendment.

The right to “keep and bear arms” is a cherished feature of American liberty and is enshrined in the Second Amendment to the United States Constitution.[i] Nonetheless, this right has been the subject of steady attacks from the left for decades. Recently, supporters of the Second Amendment won an important victory when the Supreme Court struck down the Washington, D.C., gun ban.[ii] Any day now, with the pending McDonald case, the Court is expected to rule on whether the right to bear arms protects against encroachment by state and local governments as well.[iii] By Cleta Mitchell Thursday, June 17, 2010; A21 The cynical decision this week by House Democrats to exempt the National Rifle Association from the latest campaign finance regulatory scheme is itself a public disclosure. It reveals the true purpose of the perversely named Disclose Act (H.R. 5175): namely, to silence congressional critics in the 2010 elections. The NRA "carve-out" reaffirms the wisdom of the First Amendment's precise language: "Congress shall make no law . . . abridging the freedom of speech." Congress can't help itself. Since 1798, with the Alien and Sedition Acts, incumbent politicians have yearned for legal duct tape for their opponents' mouths. The Disclose Act is a doozy of a muzzle. Speaker Nancy Pelosi has decided to follow President Obama’s lead in claiming that God directs her lawmaking, invoking the Bible as her legislative roadmap. If a conservative Republican did this, it would be the top of the news. Last week, Pelosi made a rambling, redundant, somewhat incoherent monologue in which she claimed that “The Word” directed her. She clarified that meant “The Word Made Flesh”—the incarnate Deity—Jesus Christ. She doesn’t leave us to surmise, elaborating that she makes policy decisions, “in keeping with the values of Jesus.” By RAMESH PONNURU

Bush signed the bill banning partial-birth abortion in 2003, supportive legislators gathered around for a photograph. All of them were men. Nancy Pelosi, then the House minority leader, called the image “a slap in the face to women across America.” My fellow pro-lifers winced at the picture — both because it offered Ms. Pelosi a political opportunity and because it reflected an enduring political weakness of our movement. American women are just as likely to be pro-life as American men, but few pro-life women have gone into politics. The Gallup organization recently concluded that “abortion polling since the mid-1970s finds few remarkable distinctions between men’s and women’s views on the legality of abortion.” It has found that 48 percent of American women consider themselves pro-life, while 45 percent consider themselves pro-choice. By: Philip Jauregui President Obama, The White House, and Elena Kagan are attempting to impose a “Don’t Ask – Don’t Tell” policy when it comes to the alleged private life of Kagan. The Senate and the American People should not follow this policy because the answer to the question will determine whether Ms. Kagan is merely legally incompetent, or whether she has allowed her own personal life, and her personal experiences to impact her legal decisions governing the lives of others. And that is unacceptable for any judge – especially a Justice of the United States Supreme Court. The Center for Military Readiness, an independent public policy organization that specializes in military/social issues, opposes the nomination of Solicitor General Elena Kagan to the U.S. Supreme Court. CMR President Elaine Donnelly issued the following statement in response to the Kagan nomination:
“It is unfortunate that President Barack Obama has chosen to replace the only military veteran on the Supreme Court with extensive wartime experience* with a nominee whose only significant record indicates deliberate hostility and opposition to laws protecting the culture and best interests of the American military.”
