No one can predict how the Supreme Court will ultimately rule on the Prop 8 case, but based on oral arguments today, it is possible a majority of Justices could rule that the proponents of Prop 8 lack standing and dismiss the case. If that happens, the Ninth Circuit Court of Appeals ruling would be dismissed, leaving perhaps only the Northern District of California court ruling. This would mean the ruling applies only to the northern part of California. It is possible the Court could even dismiss the district court ruling and save the issue of marriage for another case. Of course, there is always the possibility the Court could issue a limited ruling or a broad ruling on the matter...

Today, New York’s highest court, the Court of Appeals, was asked to review a challenge to the New York legislature’s vote regarding the redefinition of marriage to include people of the same gender. Liberty Counsel filed suit in the New York Supreme Court (the trial court) against the law, which was signed into law on June 24, 2011, by Gov. Cuomo. The state asked the court to dismiss the case, but Judge Wiggins sided with Liberty Counsel on the Open Meetings complaint, ruling that the case may proceed to trial. Washington DC – Liberty Counsel has agreed to represent Rev. Scott Lively, an evangelical pastor who was sued in a Massachusetts federal court by a foreign group called Sexual Minorities of Uganda (SMUG). The premise for this lawsuit is based upon the Alien Tort Statute (ATS). The ATS provides a cause of action for violations of international laws that are “specific, universal, and obligatory.” Courts have found torture, cruel, inhuman, or degrading treatment; genocide, war crimes, crimes against humanity; summary execution, prolonged arbitrary detention, and forced disappearance to be actionable under the ATS. The lawsuit claims that beginning in 2002, Rev. Lively preached in Ugandan churches and shared his opinion on homosexuality and pornography. It further claims that as a result (albeit a convoluted one), some members of the so-called LGBTI (lesbian, gay, bisexual, transgender, and intersex) community faced discrimination, and one (SMUG Advocacy Director David Kato) was killed on January 26, 2011. The suit leaves out the fact that the suspected killer is a male prostitute with which Kato had sex and refused to pay.

The suit is a direct attempt to silence Rev. Lively because of his speech about homosexuality and pornography. The Supreme Court recently heard Kiobel v. Royal Dutch Petroleum on the issue of whether the ATS allows corporations to be sued. Following oral argument, the Court ordered new briefing and will rehear the case in the fall on the broader question of “[w]hether and under what circumstances the Alien Tort Statute, 28 U.S.C. § 1350, allows courts to recognize a cause of action for violations of the law of nations occurring within the territory of a sovereign other than the United States.” This case against Rev. Lively is an example of why the ATS should not be used to allow a foreigner to file suit against a U.S. citizen in the United States, claiming a violation of some vague international norm allegedly committed in the foreigner’s home country.

Scott Lively is a gross attempt to use a vague international law to silence, and eventually criminalize, speech by U.S. citizens on homosexuality and moral issues. Kalispell, MT – The Knights of Columbus (KOC) has been ordered by the United States Forest Service to take down a World War II Memorial that includes a statue of Jesus erected in 1953 in the Flathead National Forest. Phoenix, AZ – The Arizona Court of Appeals upheld new abortion regulations which require any woman seeking an abortion to meet face-to-face with the licensed physician performing the abortion at least 24 hours prior to the abortion. The law also requires that parental consent forms be notarized in order for a minor to get an abortion. Atlanta, GA – Today the Eleventh Circuit Court of Appeals ruled in a 2-1 opinion that the individual mandate in Patient Protection and Affordable Care Act (“ObamaCare”) exceeds the authority of Congress and is unconstitutional. The court also ruled that the remainder of the law could continue in effect. The Court ruled that Congress cannot “mandate that individuals enter into contracts with private insurance companies for the purchase of an expensive product from the time they are born until the time they die.” The Eleventh Circuit case involved 26 states. Roswell against the Roswell Independent School District, for retaliating against a Christian group called Relentless in Roswell. Washington, DC – The Food and Drug Administration (FDA) quietly released a report that details the dangers for women who are considering using Mifepristone, also known as the abortion drug “RU-486.” The report states that 14 women have died and more than 2,200 women have experienced serious medical problems from the drug in the United States alone. Pensacola, FL – Today, Federal District Court Judge M. Casey Rodgers granted in part a Preliminary Injunction in favor of twenty-four clients of Liberty Counsel, and granted a request for hearing on their remaining claims. The case attracted national attention when the ACLU attempted to punish and even jail local school administrators and staff for praying over their meal. The ACLU pressured the Santa Rosa County (Florida) School Board into a Consent Decree that unconstitutionally forbids all manner of religious expression at school, right down to the mere uttering of the words “God Bless.” After vindicating the school officials charged with criminal contempt for prayer, Liberty Counsel filed suit to invalidate the unconstitutional Consent Decree. Washington, DC – This morning, the U.S. Supreme Court upheld free speech rights in a case that could have had significant negative repercussions for those who seek to express unpopular views. The Court’s ruling is in keeping with the position that Liberty Counsel advocated in the Amicus Brief it filed in the matter. In Snyder v. Phelps, Albert Snyder filed suit seeking monetary damages from the Fred Phelps family and its Westboro Baptist Church for protesting at the funeral of his son, a fallen war hero. Snyder did not actually see the protest prior to the funeral, as the protesters were more than 1,000 feet from the location, but was later told about it. Although Liberty Counsel expressly condemns the offensive tactics employed by the Phelpses and deplores the content of their rhetoric, Liberty Counsel filed an Amicus Brief in support of the First Amendment freedoms of all Americans that could be affected by the outcome of this case...

Floyd, VA – Liberty Counsel sent a letter to the Floyd County High School administration, requesting the reversal of their censorship of religious material posted by school students on the face of the students’ lockers. On February 23, Jacob Agee and other students who are members of the Fellowship of Christian Athletes posted copies of the Ten Commandments on the face of their assigned lockers. Brookville, IN – Liberty Counsel sent a letter offering to represent the town of Brookeville and Franklin County Indiana against a challenge to their display of a nativity scene outside the county courthouse. The display has been located there for more than 40 years. The Freedom from Religion Foundation recently sent a letter claiming that it is unlawful for the government to have religious displays on public property and requested that the nativity scene be moved to a private location. This Christmas display has grown over the years and now has five life-sized lighted reindeer statues and a 10-foot lighted and decorated Christmas tree in addition to the nativity scene. Richmond, VA – Today, Judge Henry Hudson ruled that the individual mandate in Section 1501 of the Patient Protection and Affordable Healthcare Act (ACA) healthcare law is unconstitutional. Judge Hudson ruled that Congress lacked the authority to mandate that every person must purchase healthcare insurance. The order severs the individual mandate from the law. Orlando, FL – Wachovia Bank’s corporate office issued a statement saying that Christmas trees are permitted and that employees who wish to decorate local branches with Christmas trees may do so as long as the trees are artificial and the lights are turned off each night for safety. Obama exempts United Federation of Teachers Union

President Obama’s administration has temporarily exempted the United Federation of Teachers, a key political backer of President Obama from certain provisions of the healthcare law. In all, 29 firms received a temporary exemption, including McDonald’s and Jack in the Box. These temporary exemptions relieve these firms from new healthcare standards that are being imposed on countless other companies around the nation. Liberty Counsel proudly congratulates Liberty University School of Law for full accreditation approval awarded by the American Bar Association* during its annual meeting in San Francisco. On August 5, the ABA Council of the Section of Legal Education and Admissions to the Bar granted full approval to the law school. Liberty University School of Law opened in August 2004. A law school must complete a full academic year before it is eligible to apply for provisional approval by the ABA. The School of Law applied for provisional approval in 2005 and was awarded provisional approval on February 13, 2006, only eighteen months after the first students arrived on campus. A law school may not apply for full approval until it has been provisionally approved for two years. Obtaining full approval is a tremendous accomplishment and a big step in fulfilling the mission of the law school...
